By accessing and using the services provided by staticehll B.V. ("Company," "we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service govern your use of our website, fitness services, and any related services provided by staticehll.

If you do not agree to abide by the above, please do not use our services. Your continued use of our services constitutes acceptance of these terms and any modifications we may make to them.

Services Description

staticehll provides weight loss and body transformation services including but not limited to:

• Personal training sessions
• Group fitness classes
• Nutrition coaching and meal planning
• Body composition analysis
• Fitness consultations and assessments
• Online resources and support materials

All services are provided at our facility located at Eikenlaan 265, Breda, or through our digital platforms as specified in your service agreement.

User Obligations

By using our services, you agree to:

• Provide accurate and complete information about your health, fitness level, and medical history
• Follow all safety instructions and guidelines provided by our trainers and staff
• Respect other clients, staff, and facility property
• Arrive on time for scheduled appointments and provide adequate notice for cancellations
• Pay all fees and charges in accordance with the agreed payment terms
• Comply with all applicable laws and regulations
• Not engage in any behaviour that could be harmful to yourself or others

Health and Safety

Your health and safety are our top priorities. By using our services, you acknowledge and agree that:

• You have disclosed all relevant medical conditions, injuries, and limitations
• You will immediately inform us of any changes to your health status
• You understand that physical exercise involves inherent risks
• You will follow all safety protocols and use equipment properly
• You will stop exercising immediately if you experience pain or discomfort
• It is recommended to consult with your physician before beginning any new exercise program

Payment Terms

Payment terms for staticehll services are as follows:

• Fees must be paid in advance unless otherwise agreed in writing
• Accepted payment methods include bank transfer, credit/debit cards, and cash
• Package deals and memberships are non-refundable unless required by law
• Late payment may result in suspension of services
• Prices are subject to change with 30 days notice
• All prices include applicable VAT

Cancellation and Rescheduling

Our cancellation and rescheduling policy is designed to be fair to both clients and trainers:

• Individual sessions require 24 hours notice for cancellation or rescheduling
• Group classes require 2 hours notice for cancellation
• Cancellations with insufficient notice may result in forfeiture of the session
• Emergency cancellations will be considered on a case-by-case basis
• Unused sessions may be transferred to future bookings within the package validity period

Intellectual Property

All content, materials, and intellectual property provided by staticehll, including but not limited to workout plans, nutrition guides, training methods, logos, and website content, are the exclusive property of staticehll B.V. and are protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive license to use these materials solely for your personal fitness and health purposes. You may not:

• Reproduce, distribute, or share our proprietary materials without written permission
• Use our content for commercial purposes
• Modify or create derivative works based on our materials
• Remove or alter any copyright or proprietary notices

Privacy and Data Protection

Your privacy is important to us. The collection, use, and protection of your personal information are governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

We comply with the General Data Protection Regulation (GDPR) and Dutch data protection laws in all our data processing activities.

Limitation of Liability

To the fullest extent permitted by law, staticehll B.V., its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to:

• Personal injury or property damage
• Loss of profits or business opportunities
• Emotional distress or mental anguish
• Any damages resulting from errors or omissions in our services

Our total liability to you for any claim arising from these terms or our services shall not exceed the amount you have paid to staticehll for the specific service giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless staticehll B.V., its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of our services
• Your violation of these Terms of Service
• Your violation of any rights of another party
• Any false or misleading information you provide

Termination

Either party may terminate the service relationship at any time with appropriate notice:

• You may terminate your membership or service package according to the specific terms of your agreement
• We may terminate or suspend your access to our services immediately if you violate these terms
• Upon termination, you remain liable for all charges incurred up to the termination date
• Certain provisions of these terms will survive termination, including payment obligations and liability limitations

Force Majeure

staticehll shall not be liable for any failure or delay in performance under these terms which is due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, government regulations, or natural disasters. In such cases, we will make reasonable efforts to resume normal operations as soon as possible.

Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or related to these terms or our services shall be subject to the exclusive jurisdiction of the Dutch courts, specifically the courts of Breda, Netherlands.

If you are a consumer residing in the European Union, you may also bring proceedings in the courts of your country of residence.

Modifications to Terms

staticehll reserves the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of our services after such modifications constitutes your acceptance of the updated terms.

If you do not agree to the modified terms, you must discontinue use of our services.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these terms will otherwise remain in full force and effect and enforceable.
